Conditions of Hire
The vessel must be controlled at all times by the listed driver(s) for vessels that do not require a license and must be 18yrs or older. All other state marine licensing rules apply. The hirer will NOT allow any other person to control the vessel unless listed on the booking form & is responsible for all occupants and their actions. Operating the vessel is only permitted during daylight hours, unless approved. Vessels allowed in smooth waters only, which ends at the Watsons Bay to Georges Head invisible line as shown on provided maps. Suitable PFD (lifejackets) for all passengers i.e. adult, juvenile, child can be provided. (Necessary for children under 12 years at all times). All body parts must be inside the vessel while in motion. All Gates must be kept closed at all times when vessel is in motion. No metal or damaged Esky's allowed on vessel at any time. One can be provided if needed. The control of the vessel and passengers is the responsibility of the hirer once they have taken the vessel from Boat Hire Rose Bay (BHRB) and BHRB will not be responsible for any loss of personal items, injuries or deaths to the hirer or its passengers. The vessel is not to operate in non-smooth water (at sea) AT ANY TIME, including in areas marked as “DO NOT ENTER” on the provided maps. The hirer must not operate the vessel in poor weather or sea/river conditions or where such conditions are imminent, if these conditions are present before the hire proceeds a transfer of reservation will be granted, however we do not grant such transfer for rain alone. If poor weather or sea/river conditions become apparent during a reservation, it is advised for the hirer to return the vessel to place of pickup for their own safety and that of all passengers and the vessel. Refunds cannot be issued once a reservation has started due to weather changes. WEATHER FORECAST MONITORING IS THE RESPONSIBILITY OF THE HIRER TO ENSURE SAFETY OF PERSONS ON BOARD THE VESSEL. Vessels are not permitted to cross coastal bars AT ANY TIME. Should the said vessel not be returned within the agreed time stipulated and the hirer is unable to be made contact with, it will be deemed the hirer to have lost/stolen the vessel and BHRB will take steps to regain possession, including police action. Additional costs will apply for a late return if not prearranged.
An additional charge of $40-80 per 15mins (or part thereof) will be charged for late return. An additional charge of $20-40 per 15mins (or part thereof) will be charged for late arrivals beyond your expected departure time. Where a late arrival/return directly impacts the next booking, you may be charged up to the full amount of the impacted booking. If your late arrival interferes with an upcoming booking, your booking may be cancelled without refund. Please arrive on time both before and after your booking. These times are sharp.
Boat must be returned in a reasonable clean state. Additional cleaning fees apply for boats not returned in a reasonable condition, at our discretion.
The hirer must pay penalty notices if issued by any Authority, occurring during the hire period. The hirer must pay for any damage or losses caused to the vessel/equipment during the hire period, including any loss of subsequent bookings in full. Insurance does not cover the loss or damage: i) To personal items ii) Due to negligence or criminal action by the hirer; iii) Resulting from overloading, speeding, overheating, seizure or misuse of the vessel iv) When the vessel is overdue for return; v) Arising from more than one accident or event vi) If at any time the driver of the vessel is not the authorised person under this hire contract. A credit card pre-authorization hold (Damage Excess/Bond) of $1,500 ($2000 for Pontoon boats) must be authorized before vessel leaves. This may be done by Credit Card or direct transfer. The bond will be refunded so long as no damage occurred to the boat during the hire period, or any subsequent loss resulting from damage etc. Allow up to 7 days for return. Where damages occur charges of up to $1500 ($2000) may be debited from the credit card provided, where damages are covered by insurance. The hirer agrees to pay the owner the cost of repair; replacement of any loss or damage howsoever caused which is not covered by insurance due to any breach by the hirer or any other caused whatsoever. Hirers will abide by all Maritime Authority, marine and environmental legislation, including being responsible for any fishing license if required. Any listed Hirer must not drive the vessel whilst under the influence of liquor or drugs, or with a blood alcohol content in excess of any statutory limit. Permissible concentration of alcohol for drivers of recreational vessels is less than 0.05. Random breath testing can be conducted on drivers, penalties range from $1100 for a first offence in the low range to $5,500 and up to 2 years imprisonment. The hirer WILL accept the consequences if he/she or any listed co-driver breach these conditions and will not be covered by insurance if found to be in breach of the conditions. Bookings are confirmed when full payment has been received. While we endeavor to keep your time slot as originally booked, all booking time slots are subject to change +/- 1hr pending other bookings we receive, and you agree to allow such change. Cancellation of bookings are only made by BHRB where extreme hazardous weather conditions are forecasted on the day and time of hire i.e. winds greater than 50kmh, or rain more than 15mm's. On cancellation you will be offered a chance to book another day in replacement of your original booking to the same value or less within 3 months. Failure to use your credit within this time will result in it being forfeited. Credit Card Surcharges are non-refundable. The Hirer acknowledges and accepts that the use and operation of this vessel is subject to inherit risks and dangers. The Hirer accepts those risks and agrees to indemnify the Owner of the Vessel for any losses suffered by the Hirer, any passengers or any third party as a result of the materialisation of those risks and dangers. The Hirer also undertakes to advise all passengers of the risks and dangers associated with the use and operation of the vessel prior to boarding. The hirer acknowledges & understands all safety material and briefings that have been presented prior to departure. By signing the hire contract, the hirer acknowledges that they have read, understand & agree to be bound by the terms and conditions of this rental agreement as printed on this document and have made them-self familiar with both the location & content of the safety management plan and operating manual and understands these documents. The location of all safety equipment and procedures to follow for any emergency or hazard are located within these documents. The hirer is responsible for all occupants complying with all agreements and any water violations may be billed to the credit card. Confirmation and sighting of the hirers’ identification will be required. Any other passenger wishing to drive the vessel will also be required to present a valid form of I.D. (such as Drivers Licence, Passport or Photo Card), and must be at-least 18 years old.
Please arrive at least 30 mins before your start time, late arrivals will result in reduced hire time, late fees or cancellation. Failure to arrive within 45mins of your scheduled meeting time (starting from 30mins before your booking time) may result in your booking being cancelled without refund and/or additional charges.
Fuel in inclusive in hire price up to 1/4 tank (pontoon boat) and 2/3 tank (runabout boat) per booking. Additional usage will be charged at standard pump price (98 octane).
CANCELLATION POLICY
Bookings cancelled/rescheduled within 14 days will be offered a Credit for use within 3 months. Half the rental fee is due if booking is cancelled/rescheduled within 7 days. Bookings cancelled/rescheduled within 48 hours require full payment. Cancellations on Public Holiday Weekends, Special Event Days such as NYE, Xmas Day etc within 14 days require half payment, within 7 days require Full Payment. Credit Card Surcharges are non-refundable for any cancellation. Cancellations/rescheduling made by the hirer will result in a $50 admin fee, unless cancelled by us due to inclement weather or mechanical issues. Any rescheduled bookings moved to a future date (either by request or due to weather) are counted from the original booking date, not the new date, so where that original date has past, no refunds can be given.
WEATHER/MECHANICAL DISCLAIMER
Cancellation of bookings are only made by BHRB where extreme hazardous weather conditions are forecasted on day of hire i.e. winds greater than 50kmh, or rain more than 15mm's. On cancellation you will be offered a chance to book another day in replacement of your original booking to the same value or less within 3 months only. We reserve the right to cancel any booking due to dangerous swell and wind conditions at our discretion, at any time. We also reserve the right to cancel any booking due to any mechanical issues with a vessel, at any time. In the case of mechanical issues, a rescheduling will be provided within 3 months only. No Refunds are provided for either of the above. Failure to use your credit within this time will result in it being forfeited.
Fishing licenses must be obtained if needed. Fishing is NOT permitted on our Pontoon boats.
A Credit Card Surcharge of 2.2% + $0.30 will be added to all Australian Card Payments.
A Credit Card Surcharge of 3.95% + $0.30 will be added to all International Card Payments.
No surcharge for Cash or Bank Transfer.
Any Credit card surcharge not paid for upfront will be deducted from the pre-authorisation hold, post-booking.
